November, 2006
Dear Association Member:
The Design Guidelines were revised by the Board of Directors at their meeting in October, 2005.
This revision modifies the maximum daily fine in the “Covenant Enforcement Procedures” and is the first revision since February, 2005. The change approved addressed an increase of the amount of the daily fine from $25 to an amount of up to $100, for
continual disregard of covenant issues and was updated in the “Covenant Enforcement Procedures”.
Guidelines are presented to assist all residents in maintaining high standards of design and compatibility. They do not modify any requirements set forth in the Declaration of Protective Covenants (“Covenants”). The language of the Covenants controls.
The Covenants contain design review authority and broad, general objectives of the community association. The Guidelines, which may be modified from time to time, have been developed to supplement and amplify the Covenants. The Guidelines serve two purposes. First, they assist the member in designing the proposed improvement and determining how to apply for approval. Second, they provide criteria for consistent decisions by the current and future Board of Directors or their designees.
The goal of the Guidelines is to keep our community an attractive and desirable place in which to live.
When planning exterior painting or alterations, please consult the Guidelines and pertinent sections of the Covenants. A list of approved colors for home exteriors is posted on the website for your convenience. Then submit your plans to the Covenants Committee.
We have placed the Covenants, Guidelines and related material on the community website for your convenience. The web address is www.lexington-charlotte.com and the Covenants material is located in the Documents Section. This revision is released in PDF format and we have also included instructions on how to use the search function to assist you in locating your topics.
Sincerely,
Lexington
Community Association Board of Directors
